PresetSync Terms of Service

Effective date: 19 July 2026 Last updated: 2 August 2026

These Terms of Service (“Terms”) are a legal agreement between you and:

DResearch Lab Limited 51 Bracken Road Dublin D18 CV48 Ireland Email: [email protected]

In these Terms, “PresetSync,” “DResearch Lab,” “we,” “us,” and “our” mean DResearch Lab Limited. “You” means the person or organization that purchases, accesses, or uses the Services.

1. Scope and acceptance

These Terms govern your purchase of, access to, and use of:

  • the PresetSync website and account portal;
  • the PresetSync desktop applications for macOS and Windows;
  • PresetSync application licences and trials;
  • PresetSync Cloud;
  • Cloud Folder synchronization;
  • support, updates, and related services.

Together, these are the “Services.”

The desktop applications are also licensed under the PresetSync End User Licence Agreement (“EULA”). If there is a conflict, the EULA governs your licence to the desktop application and these Terms govern PresetSync Cloud, accounts, purchases, the website, and other Services.

You accept these Terms by creating an account, completing a purchase, starting a trial, accepting the EULA, or using a Service. If you act for an organization, you confirm that you have authority to bind it.

2. Eligibility and customer status

You must be at least 18 years old or otherwise legally capable of entering into a binding contract. You must not use the Services where prohibited by law.

A “consumer” is an individual acting wholly or mainly outside that person’s trade, business, craft, or profession. A “business customer” uses the Services wholly or mainly for commercial, professional, or organizational purposes. Nothing in these Terms limits a mandatory consumer right or remedy.

3. What PresetSync does

PresetSync organizes and synchronizes supported preset files and related collections between computers.

3.1 Cloud Folder

Cloud Folder uses a folder controlled by you through a compatible third-party storage provider, such as iCloud Drive, Dropbox, Google Drive, OneDrive, or another supported provider. Cloud Folder is included with a valid application licence, works without a PresetSync Cloud subscription, and remains available for perpetual offline use.

You control the selected provider account and are responsible for its charges, capacity, credentials, terms, security, availability, and retention. We are not responsible for that provider’s independent acts or omissions, except to the extent applicable law provides otherwise.

3.2 PresetSync Cloud

PresetSync Cloud is an optional hosted synchronization and storage service. It requires a valid compatible application licence, an active Cloud entitlement, internet access, and successful account and device authorization.

The application licence and PresetSync Cloud subscription are separate. Cancelling, suspending, or deleting PresetSync Cloud does not cancel or revoke a valid perpetual application licence. Cloud authorization may be checked for each hosted operation.

3.3 Third-party applications and formats

PresetSync may work with third-party creative applications, plug-ins, preset formats, filesystems, and storage providers. Their owners may change them without notice. We do not guarantee support for every product or format, identical preset behavior on every platform, or continuing compatibility with a third party’s future changes. Third-party names and marks belong to their owners, and no endorsement or affiliation is implied.

4. Accounts and security

You must provide accurate, current information and keep it updated. You are responsible for protecting your password, email account, devices, and authentication credentials; reviewing authorized computers; and promptly notifying us of suspected unauthorized access.

You must not transfer an account to an unrelated third party. We may require identity or authority verification before account recovery, ownership changes, computer deauthorization, data disclosure, export, or another security-sensitive support action.

A Personal account is for one individual. A Studio account may represent one organization and may be used by its authorized employees or contractors where the plan permits. Studio accounts do not initially provide separate employee accounts, roles, invitations, or seat administration. The Studio customer is responsible for credential sharing, access removal, privacy notices, and all activity by its authorized users.

5. Application licences

A purchased PresetSync licence is perpetual for the purchased major version unless terminated for material breach. A PresetSync 1.x licence includes updates released for 1.x; a future major version may require a separate purchase.

A Personal licence authorizes up to three computers. A Studio licence authorizes up to ten computers. Each installation must be separately authorized. We may grant a case-specific device-limit override without creating a permanent or public entitlement.

Permanent activation may create an installation-bound, signed, non-expiring offline receipt. A remotely deauthorized computer may continue to operate while fully offline until it next contacts PresetSync. You must not deliberately keep a deauthorized computer offline to evade a licence limit.

Further application licence terms, restrictions, trial terms, telemetry disclosures, and termination rules are in the EULA.

6. Prices, taxes, payments, and renewal

The price, billing period, plan, storage allowance, renewal price, and applicable taxes are shown before purchase. Base prices are in euro. EU consumer prices include VAT where required. You must provide accurate billing and tax information.

Payments may be processed by Stripe, PayPal, or another payment provider made available at checkout. The selected provider processes payment information under its own terms and privacy notice. We do not ordinarily receive or store your complete payment-card number, card security code, or online-banking credentials.

PresetSync Cloud may be offered monthly or annually and renews automatically unless you cancel renewal. You authorize the selected payment provider to charge the disclosed renewal amount and taxes.

You may cancel automatic renewal through the account portal, the payment provider’s portal where available, or support. Voluntary cancellation takes effect at the end of the paid period, with no additional grace period. A failed automatic renewal may receive ten days of continued Cloud access while payment is retried or corrected.

If payment remains unresolved after the applicable grace period, Cloud uploads and downloads are blocked and the hosted repository enters the retention process in Section 13. Your local files, perpetual application licence, and Cloud Folder functionality are not cancelled by that event.

7. Refund and withdrawal policy

7.1 Mandatory rights

Consumers may have statutory rights to cancellation, conformity, repair, replacement, price reduction, refund, or termination. Nothing in these Terms limits those rights. If digital content or a digital service is faulty, misdescribed, unavailable, or not in conformity with the contract, applicable law may provide additional remedies.

7.2 Online withdrawal

Where a consumer has a statutory right to withdraw from a distance contract, the usual period is 14 days from conclusion of a service contract. Different rules may apply in some countries or circumstances.

For immediately supplied downloadable software, we may ask for your prior express consent to begin supply and your acknowledgement that the statutory withdrawal right will be lost when supply begins. The right is lost only if all legal requirements are met and the required confirmation is provided.

For a Cloud service that begins during the withdrawal period at your request, we may deduct a proportionate amount for service already supplied where applicable law permits. Once the withdrawal period has ended, disabling renewal normally ends a Cloud subscription at the end of its current paid period.

7.3 Change-of-mind and business refunds

Except where required by law or expressly offered at checkout:

  • there is no prorated refund because you stop using PresetSync Cloud before the end of a paid period;
  • statutory consumer cooling-off rights do not apply to a purchase made wholly or mainly for business purposes; and
  • PresetSync does not offer discretionary change-of-mind refunds for an application licence or Cloud subscription.

To request cancellation or a refund, email [email protected] with the account email, order or subscription identifier, purchase date, and reason. Approved refunds are ordinarily returned to the original payment method. Where law sets a deadline, we process the refund within that deadline; payment providers and banks may require additional time to display it.

Where a statutory withdrawal right applies, you may use the model form in Appendix A, but use of that form is not mandatory. A clear written statement that identifies the purchase and says you are withdrawing is sufficient.

8. Storage limits and intended use

PresetSync Cloud plans include the storage allowance shown at checkout. The standard first-release allowances are:

  • Personal Cloud: 10 GB of current logical synchronized data and up to three active Cloud computers.
  • Studio Cloud: 25 GB of current logical synchronized data and up to ten active Cloud computers.

Usage is normally measured from the current logical active synchronized file set. Trash, tombstones, conflict copies, and internal recovery metadata ordinarily do not count against the active allowance. The current maximum synchronized file size is 100 MiB and may be configured for technical, security, or operational reasons.

When quota is exhausted, new uploads and migration may be blocked; downloads and deletions may remain available; and local changes may remain pending. A pending collection must not be treated as fully synchronized.

PresetSync Cloud is specialized storage for supported preset files and closely related configuration or collection data. It is not a general-purpose cloud drive, bulk file-transfer service, backup destination, archival service, content-distribution network, or storage service for unrelated documents, media, databases, executables, or other data.

You must not disguise, rename, split, encode, or otherwise manipulate unrelated content to bypass file-type, file-size, quota, or intended-use restrictions. We may reject, quarantine, suspend, or remove prohibited content and may suspend an account used materially or repeatedly as generic storage, subject to reasonable notice where practicable and any mandatory legal rights.

9. Customer content

You retain ownership of content you synchronize. You grant us a limited, non-exclusive licence to host, store, copy, transmit, hash, verify, process, back up, restore, and otherwise handle that content only as reasonably necessary to provide and secure the Services, diagnose problems, respond to support, enforce these Terms, and comply with law.

We do not acquire ownership of your presets and do not use synchronized preset content to train general-purpose artificial-intelligence models.

You are responsible for having the rights and lawful basis needed to process your content. You must not store or transmit unlawful material, infringing content, malware, ransomware, malicious code, unlawfully obtained confidential information, or personal data you are not entitled to process.

10. Acceptable use

You must not:

  • gain or attempt to gain unauthorized access to any account or system;
  • probe or test vulnerabilities without written permission;
  • interfere with operation or impose an unreasonable load;
  • bypass licence, subscription, quota, file-size, security, or authorization controls;
  • automate access except through an authorized interface;
  • distribute malicious content or facilitate fraud or unauthorized access;
  • misrepresent your identity or authority;
  • use the Services in violation of sanctions, export controls, or other law; or
  • help another person do any of these things.

11. Repository authority, synchronization, and migration

A workspace has one active authoritative repository: either one customer-controlled Cloud Folder or PresetSync Cloud, not both.

Synchronization may create, modify, replace, rename, move, and delete managed files on linked computers. It may also create conflicts, recovery copies, tombstones, and repository metadata. PresetSync preserves independently changed content according to its conflict rules but cannot semantically merge every proprietary preset format.

Moving from Cloud Folder to PresetSync Cloud is explicit, staged, resumable, and validated. Cloud Folder remains authoritative until the final commit. PresetSync does not move or delete the former Cloud Folder repository during migration. After commit, continuing to use the former repository as a separate active repository may create duplicate or conflicting histories.

PresetSync promises eventual convergence when dependencies are available and writes stop, not an exact completion time. You must review status and pending work before deleting originals, replacing a computer, reformatting storage, or changing the authoritative repository.

12. Deletions, including mass deletions

PresetSync is a synchronization product. A deletion accepted from one linked computer may propagate automatically to every other linked computer and the authoritative repository.

Before a missing managed file becomes a synchronized deletion, the application checks that the configured collection root exists and is a directory, checks that the containing volume is available, waits for filesystem activity to settle, rescans, and correlates credible renames or moves. A missing, inaccessible, non-directory, or identity-mismatched root or volume is treated as unavailable, not as an empty collection or deletion intent.

After those checks, stable deletions may publish automatically regardless of their number or percentage of a collection. There is no promise of a mass-deletion threshold, bulk-deletion warning, separate review queue, confirmation prompt, or deletion notification. Malware, a compromised account or computer, an authorized user, filesystem tools, plug-ins, or another application can therefore cause many deletions to synchronize.

Every ordinary accepted file deletion creates a tombstone and a PresetSync Trash entry. Restore preserves the file’s identity and never intentionally overwrites an occupied path. Explicit Empty Trash, permanent deletion, Cloud account purge, and the separately confirmed support action Reset Sync Data can make content irrecoverable; Reset Sync Data is not required to create per-file Trash entries.

PresetSync currently has no collection-level “Delete Everywhere” action. Removing or unmapping a collection from one computer does not delete its local files or cloud data.

You are responsible for maintaining an independent, current, tested backup outside the active PresetSync repository and outside any folder whose changes PresetSync synchronizes.

13. Trash, Cloud expiry, and deletion

Cloud Folder retains deleted preset objects in its PresetSync-managed Trash for at least 30 full days unless you explicitly empty Trash sooner. Cleanup may occur only when an authorized application next opens and maintains the repository, so physical deletion is not guaranteed at an exact time.

PresetSync Cloud Trash is governed by the retention period shown in the application, account portal, or current service description. Recovery depends on the content still existing in the applicable repository and retention period. Trash is not a backup.

After Cloud access ends, the hosted repository becomes inaccessible and is retained for 90 days. Resubscribing during that period may restore access. After the retention period, we may permanently delete active content, Trash, recovery and conflict versions, journals, paths, and repository metadata. Deletion is validated and resumable; physical cleanup and backup rotation may take additional time. Once deletion has completed, restoration is not guaranteed.

Account purge removes the Cloud account and Cloud-only data but preserves the separate perpetual application licence and records we must lawfully retain.

14. Availability, outages, and risk of data loss

We aim to operate the Services reliably but do not guarantee uninterrupted, error-free, or loss-free operation. Maintenance, deployments, network or infrastructure failure, security incidents, third-party failure, legal requirements, force majeure, or defects may delay or prevent synchronization. No service-level agreement applies unless we sign a separate agreement expressly identified as one.

A Cloud outage, network failure, authentication failure, quota exhaustion, suspension, cancellation, or expiry does not by itself instruct PresetSync to delete local files. Local changes may continue and remain pending, but they are not protected by PresetSync Cloud until successfully uploaded and acknowledged. The absence of an error message is not proof that every change has uploaded.

Synchronization can propagate corruption, unwanted edits, and small or mass deletions. Trash, conflicts, immutable objects, backups, and recovery processes reduce risk but do not guarantee restoration of every file or version. Data may be unrecoverable following permanent deletion, expiry of retention, storage or backup failure, a malicious or authorized action, customer-device failure, third-party-provider failure, or a combination of failures.

Nothing in this section excludes responsibility that cannot lawfully be excluded, including mandatory consumer remedies or data-protection obligations.

15. Third-party services

We use or may make available third-party services for payment, email, website and WordPress hosting, DNS, security, private object storage, server hosting, monitoring, diagnostics, support, and professional services. These may include Stripe, PayPal, Better Stack, Cloudflare, Hostinger, Resend, WordPress-related service providers, and a storage provider you select for Cloud Folder.

Some providers act as our processors, while payment providers and customer-selected storage providers may also act as independent controllers under their own terms and legal duties. The Privacy Policy explains current categories, purposes, and data-sharing practices.

We may replace a provider where reasonably necessary, provided that doing so does not reduce mandatory privacy, security, consumer, or contractual protections.

16. Suspension, termination, and discontinuation

We may restrict, suspend, or terminate a Service where reasonably necessary for overdue payment, material or repeated breach, unlawful activity, generic-storage misuse, fraud, security risk, interference, circumvention of controls, legal exposure, or a binding legal requirement.

Where reasonably possible, we will give notice and an opportunity to remedy the issue. Immediate action may be necessary to prevent harm, contain an incident, or comply with law. Cloud suspension normally does not terminate a valid perpetual application licence.

We may discontinue a Service or material feature with reasonable notice where practicable. If an active paid Cloud subscription is materially affected, we will provide the remedy required by law and may provide continued access, retrieval or export time, a proportionate refund, or another appropriate remedy.

17. Privacy and data protection

Our Privacy Policy explains how we process personal data, including default-enabled, scrubbed operational and crash telemetry and the applicable data-protection rights, including objection rights.

When a business customer places personal data in synchronized content for its own purposes, that customer may be the controller and DResearch Lab Limited may be its processor. The business customer is responsible for a lawful basis, required notices, data-subject requests, and appropriate access controls. A data processing agreement may be made available where required.

18. Intellectual property and feedback

PresetSync software, code, interfaces, documentation, website, branding, and non-customer content are owned by or licensed to DResearch Lab Limited. No ownership transfers to you.

If you provide feedback, you permit us to use it without restriction or payment, provided that we do not publicly identify you as its source without permission. This does not transfer ownership of customer content.

19. Disclaimers

Subject to mandatory law, the Services are provided “as available.” We do not guarantee that every defect will be corrected; every format, application, filesystem, or provider will remain compatible; synchronization will be continuous; a preset will work after transfer; or every deleted or previous version can be recovered.

These disclaimers do not remove our obligation to supply conforming digital content and services or any mandatory consumer right.

20. Limitation of liability

Nothing excludes or limits liability for death or personal injury caused by negligence where prohibited, fraud, fraudulent misrepresentation, wilful misconduct, mandatory consumer remedies, data-protection rights, or any other liability that cannot lawfully be excluded or limited.

For consumers, we remain responsible for loss that is a reasonably foreseeable result of our breach or failure to use reasonable care and skill, subject to applicable law. We are not responsible for business losses suffered by a consumer using the Services mainly for private purposes.

For business customers, to the maximum extent permitted by law, we are not liable for loss of profit, revenue, anticipated savings, opportunity, goodwill, business interruption, indirect or consequential loss, or loss or corruption of data that a current independent backup could reasonably have avoided.

Subject to the liabilities that cannot be limited, our aggregate liability to a business customer for the affected Service is limited to the amount paid for that Service in the 12 months before the event, plus the price paid for the affected perpetual application licence.

21. Business-customer indemnity

A business customer is responsible for losses, liabilities, and reasonable costs directly arising from a third-party claim caused by content it had no right to synchronize, its unlawful processing of personal data, deliberate misuse, or material breach of acceptable use. This does not apply to the extent the claim was caused by our breach, negligence, or unlawful conduct.

22. Events outside reasonable control

Neither party is responsible for delay or failure caused by an event outside its reasonable control, such as natural disaster, fire, flood, war, terrorism, civil unrest, government action, major internet, telecommunications, cloud, or electricity failure, epidemic, or a criminal cyberattack that reasonable security measures could not prevent.

This section does not excuse payment obligations already due or any duty or liability that cannot lawfully be excluded.

23. Changes to the Services and these Terms

We may update the Services for security, compatibility, legal compliance, reliability, provider changes, misuse prevention, or product development. We may require an update where reasonably necessary for security or continued Cloud operation.

We may update these Terms and will publish the revision date. We will give additional or advance notice where required or reasonably appropriate for a material change. We will not apply a material change retroactively where doing so would be unlawful or unfair. If express acceptance is required, we may ask you to accept revised terms before continuing to use the affected Service.

24. General

You may not assign an account or licence to an unrelated third party without our written consent, except where law gives you that right. We may transfer these Terms in a merger, restructuring, financing, or sale of the PresetSync business without reducing mandatory rights or privacy protections.

If a provision is invalid or unenforceable, it will be adjusted or removed only to the necessary extent and the remainder continues. A failure to enforce a provision is not a waiver.

These Terms, the EULA, the Privacy Policy, checkout information, and any additional terms expressly accepted for a Service form the agreement. A separately signed agreement prevails where it expressly overrides them.

25. Governing law and complaints

These Terms are governed by Irish law. The courts of Ireland have jurisdiction, but a consumer retains mandatory protections of the country of residence and any right to bring proceedings there. Either party may seek urgent protective relief in a court with appropriate jurisdiction.

Please send complaints to [email protected] with your account email, relevant order or subscription identifier, dates, and a clear description. Consumers may also contact the Competition and Consumer Protection Commission, the Irish Data Protection Commission, a competent authority in their country, or an applicable European Consumer Centre.
